Description
Ordinance No. 2025-07 amends Chapter 86 of the Town of Orchid Code of Ordinances to establish procedures for certified recovery residences in accordance with Section 397.487, Florida Statutes. The Ordinance creates a new Section 86-12 authorizing certified recovery residences in the Multi-Family Residential Zoning District and establishes a process through which an applicant may request a reasonable accommodation from otherwise applicable Town land use regulations. It sets application requirements, review standards, timelines, and procedures for Town Manager review and Town Council determination; provides for alternative accommodations, appeals, and written decisions; prohibits fees for reasonable-accommodation requests; and addresses ongoing compliance, revocation, and modification of approved accommodations. The public purpose of the Ordinance is to bring the Town’s zoning regulations into compliance with state law, provide a clear and fair process for considering certified recovery residences and reasonable-accommodation requests, and administer those requests consistently with applicable federal fair housing and disability-access requirements.
